Who has to comply

Voluntary in most of the world. In the European Union, the recast Energy Efficiency Directive (EU) 2023/1791 makes it effectively mandatory for large energy users: enterprises with average annual consumption above 85 TJ must implement a certified energy management system by October 11, 2027, and those above 10 TJ must either run a qualified energy audit every four years (first by October 11, 2026) or hold a certified EnMS.

In the US it is voluntary and often used to support utility incentive programs and the DOE 50001 Ready program.

EU Energy Efficiency Directive triggers

Directive (EU) 2023/1791 Article 11 sets two thresholds based on average annual consumption over the previous three years. Above 85 TJ: implement an energy management system certified by an independent body by October 11, 2027.

Above 10 TJ: carry out an energy audit by October 11, 2026 and every four years after, unless a certified EnMS or an environmental management system that includes a compliant energy audit is in place. Member states transpose the details, so check national rules for penalties and reporting.
