What a Idaho business has to have in writing

Idaho imposes one of the lightest written-policy loads in the country. There is no comprehensive privacy law, no data security statute, no state harassment policy or training mandate, no salary-range disclosure rule and no state OSHA plan, so federal OSHA covers private workplaces directly.

What Idaho does require sits in licensing and registration: contractors and public works contractors must register with DOPL, every business needs a Secretary of State and Tax Commission registration, and employers must post the Department of Labor notices, report new hires and carry workers' compensation.

The one voluntary written policy that pays for itself is a drug-free workplace program, which earns a workers' compensation premium credit.

What applies

Idaho rules for a 15–19 person general business

State law only. The federal layer every employer carries sits on the business-type pages below. Each row names what you must write, post, file or certify, who enforces it, and links to the state authority.

Breach Notification 1Who you must tell after a data breach, and how fast

LawProduceWhat it requiresTriggerEnforced by
Disclosure of breach of security of computerized personal informationAI-compiledIdaho Code §§ 28-51-104 through 28-51-107Any individual or commercial entity that conducts business in Idaho and owns or licenses computerized data containing personal information about Idaho residentsDistribute
Notice
Investigate promptly and in good faith once a breach is suspected, then, if personal information has been or is likely to be misused, write and send notice to affected Idaho residents as soon as possible without unreasonable delay. Businesses may tell the Attorney General but are not required to; public agencies must notify the Attorney General within 24 hours. A regulated business that follows its own regulator's breach procedures is treated as compliant.

State Vendor Security Program 1Certification a vendor needs before selling cloud services to the state

LawProduceWhat it requiresTriggerEnforced by
State of Idaho Standard Terms and Conditions for Cloud ServicesAI-compiledIdaho Division of Purchasing standard cloud terms; Executive Order 2017-02 (NIST Cybersecurity Framework)Any contractor supplying cloud or hosted services to Idaho state agenciesCertify
Certification
A procurement condition, not a statute. Idaho's standard cloud contract terms, which take precedence over the general state contract terms, require that state data be stored in a FedRAMP accredited cloud service, and require the contractor to pay for an independent audit of its data centers at least once a year and hand the state an unredacted copy within thirty days of publication. A SOC 2 report is the required audit type unless the state agrees to another. Services and data at rest must sit in United States data centres inside a physical security perimeter, and the state keeps a right to inspect them on ten days' notice. Separately, the Idaho Administrative Office of the Courts participates in GovRAMP and runs its own vendor security review for judicial branch contracts.
